Excerpts from Judgements

1. Bogutin (Feb., 1998)  "Although there is no doubt that the Nazis executed numerous people in Selidovo, there was no evidence to demonstrate that Mr. Bogutin was involved in the executions...I am not satisfied that the Minister has met the burden of proof upon her to demonstrate that Mr. Bogutin was involved in any executions. Speculation is not evidence." [paragraph 32]

2. Vitols (Sept., 1998)  "The Minister is not seeking to show any participation by Mr. Vitols in atrocities against the civilian population.  The Minister's case is based on Mr. Vitol's membership in criminal organizations.  Notwithstanding this concession, counsel for the Minister from time to time sought me to infer otherwise."  [paragraph 75]

3. Podins (July, 1999)  "The Plaintiff [Minister] does not allege that the defendant personally engaged in atrocities or crimes." [paragraph 1]

Dueck (Dec., 1999)  "The applicant [Minister] admitted at the beginning of the hearing that she had no evidence to support the allegation that the respondent [Dueck] participated in any of the executions alleged in the Summary..."  [paragraph 11]  "...and since the applicant has admitted that there is no evidence to support the allegation that the respondent participated in executions, I must conclude that the applicant has not succeeded in bringing the respondent within the ambit of the Notice."  [paragraph 148]

Katriuk (Jan., 1999)  "The Minister has not proven, on a balance of probabilities, that the respondent participated in the commission of war crimes or that he committed such crimes.  The Minister did not call any witnesses who could link the respondent to the atrocities committed against the civilian population."  [paragraph 67]  "...the Minister did not adduce any evidence... to prove this allegation that the respondent had committed war crimes."  [paragraph 73]

6. Oberlander (Feb., 2000)  "There is no evidence that the respondent participated in any of the atrocities committed against civilians (as charged by the government)..." [paragraph 197]
