to have 4 expert witnesses excluded from trial
BERLIN - The attorney for John Demjanjuk is asking that four
witnesses be excluded from giving expert testimony because he says they
are biased.
Lawyer Ulrich Busch filed a motion Tuesday to exclude the
witnesses, including a historian who in the past said Demjanjuk is a
"monster" who "should be hanged."

The Munich state court made no immediate ruling on the motion.
It was not clear when the witnesses were scheduled to testify.
Demjanjuk is standing trial on 27,900 counts of accessory to

The 90-year-old retired Ohio autoworker denies ever being at
any camp, claiming he is the victim of mistaken identity.

Attorney Ulrich Busch filed a motion with a German court on Tuesday to
not allow the witnesses, including a historian who in the past said
Demjanjuk was a "monster" who "should be hanged."
The 90-year-old Demjanjuk is standing trial on 27,900 counts of
accessory to murder on allegations he was a guard at the Nazis' Sobibor
death camp during World War II. He denies ever being at any camp,
claiming he is the victim of mistaken identity.

There is not one single witness alive today that can positively
identify JD in the concentration camps. I don't deny the possibility he
may have been conscripted by the Germans to be a low level camp guard.
But it is absurd to suggest JD is a major war criminal. the germans
have a lot nerve puuting him on trial. They invade his country.
Forcibly conscript him into their ranks. And now they think they are
somehow in a position to judge him. If he truly was a brutal war
criminal, the Israelis would have never overturned his conviction and
released him.

IF Demjanjuk was at Sobibor, he was a soldier following orders.
40 years from now, the Iraq war might be seen as an unjust war by the
world community. Does this mean that OUR soldiers should fear being
persecuted and prosecuted for following orders too?

I don't understand the logic of the German government in prosecuting
this case unless they were pressured by the US government because we
needed somewhere to deport him. Ridiculous.
Also, Eli Rosenbaum's OSI division at the DOJ needs to be shut down. Total waste of money.

Let me preface this comment by saying I'm biased in Demjanjuk's favor,
and always have been. I don't know if it's because he's an old guy from
Cleveland, or that he's been dragged around the world to salve the
conscience of so many who don't want to know the facts but thirst for
vengence. That being said, I wonder if I might not be missing a salient
point myself. Does simply having avoided justice earn someone a free
pass for their crimes, especially crimes of the nature he is being
accused of? I don't know, but I do know that nothing that comes from
this trial will give anyone any satisfaction. If he wins, he's still
lost a major portion of his life to foreign prosecutions and will live
out the remainder of his life under a cloud of suspicion that he got
away with it. If he loses, then the few remaining years he has left
will be spent in German prison hospitals while his lawyers appeal his
case until he dies of natural causes. In the end, one way or another,
there will be a dead old man and a huge bill for the German people all
so they can try to distance themselves from the crimes of their
fathers. Nobody's buying that either.
